FNE has teamed up with the Brussels based team of the International Union of Cinemas (UNIC) to bring you regular updates on EU cinema policies that impact all industry professionals across Europe.
Each two weeks the UNIC team of experts will update FNE readers with a selection of information on the most important developments in cinema policy in the areas of the Digital Single Market, copyright, new research on audience development, policy meetings and events and other vital information that the leaders of the European cinema need to keep abreast of to do their jobs.
These are issues that have an impact on all of us and will determine the future direction of our industry and indeed even its survival.

29/10: The Observatory launches two major studies on how SMEs and young Europeans perceive IP - EUIPO
The two EU-wide studies focus on the perceptions of IP among European citizens and are the second editions of the IP SME Scoreboard and Youth Scoreboard series, which were first released by the EUIPO in 2016.

On 24 October, Prime Minister Antti Rinne and President-elect of the European Commission Ursula von der Leyen met in Helsinki to discuss the finalisation of the next multiannual financial framework (MFF), i.e. the EU’s long-term budget (2021–2027), and the priorities of the next European Commission.
EU Copyright Directive
/10: Poland seeks annulment of Article 17 of the DSM Directive – EAO Newsletter
On 12 August 2019, Poland’s application to the Court of Justice of the European Union (CJEU) seeking annulment of a provision in the recently adopted Directive 2019/790 on Copyright in the Digital Single Market (DSM Directive) was published in the Official Journal of the European Union. The DSM Directive was adopted on 17 April 2019 and Poland’s action was brought on 24 May 2019. The application seeks annulment of two provisions under Article 17 of the DSM Directive concerning the liability of “online content-sharing service providers” for content uploaded by users.

MEPs adopted a resolution urging member states to work on long-overdue rules obliging multinationals to disclose what taxes they pay in each country.

The official and final turnout of the 2019 European Elections is set at 50.66% (up 8.06 pp on 2014), following the publication all 28 final national turnout data.

Finnish Presidency of the Council of the EU
18/10: Finland presented work on implementation of EU Strategic Agenda – eu2019.fi
The European Council discussed the follow-up to the Strategic Agenda for 2019–2024 in Brussels on 18 October 2019. Finland is now the first presidency to integrate the priorities of the Agenda, adopted in June, into the Council’s practical work. Finnish Prime Minister Antti Rinne informed the EU leaders of the progress made in the implementation.

09/10: The independence of media regulatory authorities in Europe - EAO
Europe’s main piece of media legislation – the Audiovisual Media Services Directive (AVMSD) – was recently revised and a new version entered into force last autumn. This new AVMSD introduces an obligation for EU member states to designate one or more independent national regulatory authorities to oversee the broadcasting and audiovisual media sector in Europe.

Finland organised a high-level gender equality conference in Helsinki from 30 September to 1 October 2019 in the context of Finland’s Presidency of the Council of the European Union. The aim of the conference was to increase the dialogue between gender equality policy and economic policy and to strengthen gender equality in the EU’s decision-making.

20/09: Circular Plastics Alliance: 100+ signatories commit to use 10 million tons of recycled plastic in new products by 2025 - European Commission
The declaration lays out how the alliance will reach the target of 10 million tons of recycled plastic used to make new products every year in Europe, by 2025. This target was set by the European Commission in its 2018 Plastics Strategy, as part of its efforts to boost plastics recycling in Europe.

27/05: Council calls for an ambitious approach for a competitive single market - Council of the EU
The Council adopted conclusions on "A new level of ambition for a competitive single market". These conclusions are the Council's response to recent calls from the European Council for an integrated, forward-looking approach to the single market, which should connect all relevant policies and remove remaining unjustified barriers and avoiding creating new ones, in particular on freedom to provide services and on digitalisation.

/05: Directive on copyright and online transmissions of broadcasting organisations and retransmissions of television and radio programmes – EAO Newsletter
The stated purpose of the Directive under the new Article 1 is to lay down rules to enhance cross-border access to a greater number of television and radio programmes by facilitating the clearance of rights for the provision of online services that are ancillary to the broadcast of certain types of television and radio programmes and for the retransmission of television and radio programmes.

/05: Court prohibits arbitrary changes to pay-TV programme package – EAO Newsletter
In a recently published judgment of 17 January 2019 (Case no. 12 O 1982/2018), the Landgericht München (Munich district court) decided that customers were unreasonably disadvantaged by a unilateral, groundless change to programme packages sold by pay-TV provider Sky Deutschland.

The objectives of this Directive were to enhance the good functioning of the internal market and to stimulate innovation, creativity, investment and production of new content, also in the digital environment. The signatories support these objectives.
15/04: EU adjusts copyright rules to the digital age – Council of the EU
The EU is amending its legal framework on copyright to make it fit-for-purpose in today's digital environment. The Council today adopted a directive that modernises existing EU copyright law to pave the way towards a true digital single market. The new rules ensure adequate protection for authors and artists, while opening up new possibilities for accessing and sharing copyright-protected content online throughout the European Union.

The EU is taking steps to increase the number of TV and radio programmes available online for European consumers. The Council adopted a directive which will facilitate the licensing of copyright-protected material contained in such programmes so that they can be made available throughout the EU.

The new law replaces an earlier Audiovisual Code from 2006 (see IRIS 2006-9/27). The EU is amending its copyright legal framework to make it fit-for-purpose in today's digital environment. Representatives of the Romanian presidency of the Council reached a provisional agreement with the European Parliament on a draft directive that introduces changes to existing EU copyright rules as part of creating a true EU digital single market.
